Anyone who wants to get married in NY must get a Marriage License first. Here is information about the steps that you will need to take to get a Marriage License so that you can get married. 

How much does a Marriage License cost?

A marriage license costs $35 and you can pay by credit card or money order (make it payable to the City Clerk).

How long is my marriage license valid?

A NY Marriage License is valid for 60 days (it is valid for 180 days for active military personnel but only 60 days for everyone else).  You can use your marriage license to get married anywhere in NY, but it may not be used outside NY.

What are the steps of the application process?

  1. You begin the process online or by filling out a paper form for a Marriage License.  The online process is faster.
  2. After you fill out the application (online or in person) you then complete the process by appearing with your fiancé at the Office of the City Clerk in person (make sure you go to this office together not separately).  You cannot have someone else go with you for your fiancé if they cannot attend, you will be turned away if you do not show up with the person you intend to marry.
  3. You then get the application from the information desk and complete it there in their office.
  4. They will process your Marriage License while you wait.
  5. Make sure to check it for mistakes before you leave.
  6. Now that you have your certificate you are free to get married after 24 hours.

What do I need to fill out the Marriage License Application?

You will need these items:

  • You and your fiancé must bring proper identification.
  • You must fill in your: 1) names; 2) current addresses; 3) city, state, ZIP code and country; 4) country of birth; 5) date of birth; 6) name and country of birth of your parents; 7) Social Security numbers; 8) and your past marital histories.
  • You have to sign an affidavit that there are no legal impediments to the married (ex. You cannot get a marriage license while you are waiting for a divorce judgment.)
  • You must list all prior marriages. You will need your prior spouse’s full name; the date the divorce was granted; and the city, state and country where the divorce was issued.
  • Bring a copy of any divorce judgments.
  • If your prior spouse died, bring a copy of the death certificate.

How do I go about changing my last name?

You can change your last name through marriage as long as the change is within the type allowed on the back of the application.  The name change will take legal effect once your Marriage Ceremony is over.  You can only change your last name (not your first or middle name).

What happens if I lose my Marriage License before the Ceremony takes place?

You can get a Duplicate Marriage License if your original is lost, stolen or mutilated.  You will have to pay a $25 fee by credit card or money order.  You will need to return to the office that issued the original and complete a Duplicate Marriage License affidavit.

Can I get married if I am under the age of 18?

How do I get married at the City Clerk’s office?

You have to go with your fiancé during regular business hours.  Bring your witness with you, they have to be over the age of 18.  You, your fiancé, and your witness must all have proper identification with you.  You cannot make a reservation or appointment in advance, you just have to arrive ready and with enough time to have the ceremony (ex. Do not arrive at 4:45).

What if I want to get married on my own outside of the City Clerk’s office?

You can have a civil or religious Marriage Ceremony anywhere within the State of NY.  It has to be conducted by a Marriage Officiant who is eligible to perform the Marriage.  That person has to be registered with the office of the City Clerk before the wedding.  You can call 311 to verify whether they are registered with the City Clerk’s office.  Once your Ceremony is over, you, your spouse, the Officiant and the witnesses must sign the Marriage License.  Then the Officiant must return the Marriage License to the office where it was obtained within 5 business days.

How do I get my Certificate of Marriage Registration?

This is the document that lists the date, time, location, Marriage Officiant’s name and title, and any changes in surname from your wedding.  If you are married in the City Clerk’s office you will receive it at the end of your Ceremony.  If you have your wedding on your own, you will receive it in the mail within about 20 days from the date that the Clerk’s office receives and processes the Marriage License that they receive from the Officiant.  If you haven’t received it in about a month, contact the City Clerk’s office where you received your marriage license.
