How Do I Revoke my Affidavit of Support?

f you have filed an affidavit of support on behalf of a spouse, family member or friend, you cannot revoke it.  The affidavit of support will stay in effect until:

  1. Either you or the person you have agreed to support dies; or
  2. The person you have agreed to support becomes a US Citizen; or
  3. The person you have agreed to support works in the US for the equivalent of 40 quarters (10 years); or
  4. There is a formal determination that the affidavit of support and permanent residency has been abandoned.  Say for instance your spouse got their green card through marriage to you, a US citizen, and they leave you to return to their home country for several years and never remove the conditions on their permanent residency (only had 2 year conditional green card when they left) then they most likely will not have filed to remove the conditions on their green card.  This means that there may be a formal determination that their residency has been abandoned--but you might want to contact an immigration lawyer about this or call USCIS directly after that time.
